CBMU WORKSHOP:
PLEASURE CRAFT OPERATOR CARD

Effective September 15, 2009, all operators of pleasure craft fitted with a motor and used for recreational purposes are required to provide proof of competency.

This requirement has been introduced in stages over the past ten years and now has been fully implemented. This requirement has now presented another level of regulation and the impact thereof on operators and insurers has provoked considerable debate amongst our membership.

Whilst it is expected that most operators will be in compliance, there will certainly be instances of non-compliance. Until such time as this non-compliance is actually tested in the courts, we must rely on similar jurisprudence in interpreting its application on policy coverages.

Some issues of consideration:

  • Criminal Offence vs Civil Offense
  • Penalties for non-compliance
  • Not having on board vs not having at all
  • Application of hull coverage
  • Application of liability coverages
  • Dedicated marine coverage vs coverages under homeowner’s insurance

The CBMU Underwriting Committee is hosting a workshop to debate this issue and invites all of our membership to attend and participate.
