Release of the Report to Parliament on the Hamburg Rules

Prior to the implementation of the Hague-Visby Rules in Canadian law,
extensive consultations were conducted with various industry groups on
whether Canada should adopt the Hague-Visby or Hamburg Rules. In the
absence of a consensus by industry, it was agreed that Canada would adopt a
staged approach to both regimes. While the Hague-Visby Rules were adopted
immediately, a mechanism allowing for the future adoption of the Hamburg
Rules was provided. The Minister of Transport is required to review and
submit a Report to Parliament as to whether or not the Hague-Visby Rules
should be replaced by the Hamburg Rules. This is the second statutory
review of the Hamburg Rules under section 44 of the MLA and it contains
recommendations about the future of Canada’s carriage of goods by water
legislation.
